Q: What forms must be filed to collect benefits on my injury case?

A: If involved in a motor vehicle accident, there are several No Fault forms with strict deadlines that must be filed with the proper insurance companies.  Beware, there are many odd and strange situations which make me wonder sometimes who is the primary No Fault carrier in an accident.  In such situations, I file with all potential carriers and essentially let them sort it out.  Other times, there are second and even third levels of No Fault insurance coverages with higher coverage limits availble to our client.  We file with these potential No Fault carriers also in the same manner as the primary insurane carrier.  So a good rule of thumb when in doubt file with everyone, when your sure file with everyone anyway.  I will post some of the strange situations shortly.

OK - Now that that is out of the way here is a list of some of the common forms required: 
NF2 Application for No Fault Benefits is due within 30 days following the accident to the insurance company (or companies) responsible for No Fault coverage;
DB-450 forms for short term disability which is due essentially immediately, if you lose work, to your employer's disability insurance company;
NF5 Hospital Facility forms are due to the hospital and other medical providers, who have 45 days to submit their bills from the date of your treatment to the proper insurance company;
NF6 Wage Verification forms due to the proper No Fault insurance companies to recover your lost wages;
MV-104 form is due at DMV in Albany for drivers of motor vehicles, if the accident involved injury to persons or property damage above $1000 

Their are numerous other notices included in our letters to the insurance companies that are also required for triggering coverages, such as supplemental underinsured motorist and uninsured motorist coverage (SUM/UM) pursuant to regulation 35D and Notice of Intention forms. 

Then their are strict time limits for bringing notices against the other driver or vehicle, especially involving any non-private individual such as government employees or agencies, whether they be local, town, city, or federal employees. 




No Fault was designed in the early 1970's in new york to allow those injured as the result of a car accident to obtain medically necessary treatment without regard to who was at fault for the accident, hence the term No-Fault.
